Terms and Conditions for Donations

Organization: Yogi Gupta Society, Inc. (the “Organization”), a tax-exempt religious and charitable corporation duly incorporated under the laws of the State of Florida and recognized by the Internal Revenue Service as a 501(c)(3) organization with Employer Identification Number (EIN) 46-4557291.

These Terms and Conditions (“Terms”) govern all donations made to the Organization through our website, payment processors (including WooCommerce, WooPayments, PayPal, Stripe, Zelle, or any other method), or by any other means. By making a donation, you agree to be bound by these Terms. If you do not agree, please do not donate.

1. Purpose of Donations

The Organization is a tax-exempt 501(c)(3) religious and charitable organization. All donations are voluntary contributions made to support our religious, charitable, educational, and community programs. Donations are irrevocable once made.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to make a binding donation. Donations from outside the United States are welcome, but you are responsible for any international taxes, fees, or compliance requirements.

3. Donation Process and Payment Methods

  • Donations may be made as one-time gifts or recurring (monthly/annual) contributions.
  • Accepted payment methods include credit/debit cards, PayPal, Zelle (via direct bank transfer), and any other methods displayed at checkout.
  • All online transactions are processed securely through third-party processors (WooPayments/Stripe, PayPal, etc.). We do not store full payment card information.
  • Recurring donations will continue automatically until you cancel via your account or by contacting us.
  • You authorize the Organization (or its processors) to charge the payment method you provide.

4. Tax Deductibility

As a 501(c)(3) tax-exempt organization, donations to the Organization are generally tax-deductible as charitable contributions under U.S. federal tax law, to the fullest extent allowed by law.
IRS Acknowledgment Requirement: For any single contribution of $250 or more, you will receive a contemporaneous written acknowledgment containing:

  • The Organization’s name and EIN.
  • The date and amount of the contribution.
  • A statement that no goods or services were provided in exchange for the donation (or a description and good-faith estimate of any tangible benefits provided).
  • If applicable, a statement that any benefits provided consisted entirely of intangible religious benefits (e.g., prayers, spiritual guidance, or participation in religious services).

You should consult your own tax advisor regarding the deductibility of your donation. The Organization cannot provide tax advice.

5. Receipts and Acknowledgments

  • A confirmation email will be sent immediately after each donation.
  • Formal tax receipts for donations of $250 or more will be issued by January 31 of the following year (or sooner upon request).
  • For non-cash donations (property, securities, etc.), additional IRS forms (e.g., Form 8283) may be required; we will provide the necessary acknowledgment but not an appraisal.

6. No Refunds or Cancellations Policy

All donations are non-refundable and non-exchangeable. Because donations support ongoing religious and charitable work, they are considered completed gifts under Florida and federal law.
Exceptions may be made at the sole discretion of the Organization only in cases of:

  • Clear administrative error (e.g., duplicate charge), or
  • Fraudulent use of a payment method (we will cooperate with law enforcement and payment processors).
    Recurring donations can be canceled at any time; future charges will stop, but prior donations remain non-refundable.

7. Use of Donations

Donations will be used in accordance with the Organization’s mission, governing documents, and 501(c)(3) requirements. We reserve the right to allocate funds to the general operating fund or the most pressing needs unless you designate a specific restricted purpose (subject to our gift-acceptance policy). If a designated purpose becomes impossible or impracticable, the Organization may redirect the funds in a manner consistent with our charitable and religious purposes and in compliance with Florida law.

8. Donor Privacy and Data Protection

  • We respect your privacy. Donor information is collected only as needed to process the donation and issue receipts.
  • We do not sell, rent, or trade donor lists. Personal data is handled in accordance with our Privacy Policy [link to your Privacy Policy].
  • Payment processors (PayPal, Stripe, etc.) have their own privacy policies; we encourage you to review them.

9. Disclaimer of Warranties and Limitation of Liability

Donations are made “AS IS.” The Organization makes no representations or warranties regarding the tax treatment or impact of any donation.
To the maximum extent permitted by law, the Organization and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your donation.

10. Modifications to These Terms

We may update these Terms from time to time. Continued donations after changes are posted constitute your acceptance of the revised Terms. We will notify you of material changes via email or website notice.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any disputes arising from donations shall be resolved exclusively in the courts located in Brevard County, Florida. You agree to waive any right to a jury trial.

12. Severability

If any provision of these Terms is held invalid, the remainder shall continue in full force and effect.
